Terms and Conditions

  1. These ordering conditions (the Terms and Conditions) regulate the legal relations arising between the e-shop emmelapsepood.ee (hereinafter E-shop), Beatex Pro OÜ (Seller) and the person who made the order in the e-shop (Customer) when purchasing goods from the e-shop.
  2. In matters not regulated in the E-store Terms and Conditions, the legislation in force in the Republic of Estonia shall apply.
  3. The Seller has the right to change these Terms. Changes and additions to the terms and conditions will be notified via the e-store. Amendments and supplements to the Terms and Conditions shall enter into force upon publication of the respective amendment or supplementation in the e-store or at another time specified in the Terms and Conditions.
  4. If the order has been forwarded to the e-store before the amendments to the Terms and Conditions enter into force, the terms and conditions in force at the time of forwarding the order shall apply to the legal relationship between the Subscriber and the e-store, unless otherwise provided in the Terms and Conditions.
  5. The e-shop has the right to change the prices of the Goods for sale at any time, unless otherwise provided in the Conditions.
  6. If you have added the Goods to the shopping cart, but have not yet placed an order in the e-shop, and if the price of the Goods should change after that, the price valid for submitting the order must be paid for the Goods.

Right to lodge claims and manufacturer's warranty

  1. emmelapsepood.ee offers high-quality products, the description of which is precisely indicated on the website of the e-store. Before using the goods, the Customer must read the instructions for use of the goods and the manufacturer's recommendations in order to avoid damage resulting from incorrect use of the product. If the product does not meet the agreed conditions or does not work properly, the Customer has the right to exercise the right to submit claims. Please read the Terms of Use.
  2. After receiving the Goods, the Customer has 14 days to inspect the Goods. The Customer has the opportunity to return the Goods within the aforementioned term (withdrawal from the contract) by sending a corresponding notice to the e-store address info@emmelapsepood.ee and returning the Goods at his own expense.
  3. Pursuant to clause 53 (4) 41) of the Law of Obligations Act, goods with open packaging, used or damaged (incl. Damaged packaging) shall not be returned (ie the Customer loses the right of withdrawal specified in clause 2), unless the packaging has been damaged during transport and upon receipt by courier or post office. a corresponding note has been made on the delivery note or upon receipt of the goods received at the parcel machine, the E-shop has been notified immediately of the receipt of the goods with damaged packaging.
  4. In the event of withdrawal from the contract in the case provided for in clause 2, the amount paid for the purchase shall be refunded.
  5. The returned Goods shall be refunded to the current account of the Customer or another person specified by the Customer no later than within 14 days from the receipt of the withdrawal notice by the E-store, provided that the Goods have been returned to the address specified in clause 2 within the same term.
  6. The returned goods must contain all the items included in the packaging of the goods.
  7. The goods sold in the emmelapsepood.ee online store are covered by the manufacturer's warranty if it is stated in the product description or in the documents accompanying the product. The warranty is valid according to the manufacturer's warranty conditions.
  8. The warranty documents are the sales invoice. The warranty document must state the product model, date of sale. In the absence of proper documentation, the warranty does not apply. In the event of a warranty claim, it is necessary to notify the Seller of the problem either by e-mail or telephone.
  9. Defects during the warranty period will be rectified by an authorized repairer licensed by the manufacturer. In the event of a warranty claim, it is necessary to notify the Seller of the problem either at info@emmelapsepood.ee or by phone +372 56608008.
  10. Regardless of whether a warranty has been issued for the product, the Seller shall be liable for defects in the goods that existed at the time of delivery of the goods to the Customer, even if the defect occurs later, unless the Customer knew or should have known about the defect in the contract. In the case of consumer sales, the Seller is responsible for the defect of the goods, which becomes apparent within two years from the delivery of the thing to the buyer. A defect in the goods which has become apparent within six months shall be presumed to have existed at the time of delivery of the goods, unless such presumption is incompatible with the nature of the thing or defect.
  11. The repair, exchange or return of defective goods shall operate in accordance with the requirements of the legislation of the Republic of Estonia, in particular in accordance with the conditions provided for in the Law of Obligations Act. If the goods purchased by the Customer are defective, the Customer has the right to use legal remedies against the Seller.
  12. When repairing the product, it is important to bring all the details and accessories to the product.
  13. Attention! When sending the goods for repair, make sure that everything is packed correctly and the risk of the product being damaged during transport is excluded.
  14. In the event of defects, the necessary repairs to the product will always be carried out in the shortest possible time. The Seller is obliged to respond to the Customer's complaint submitted in writing or in a reproducible form in the same form and to notify the Customer of the satisfaction of the claim or the possible resolution of the complaint within 15 days as of the receipt of the complaint.
  15. Return of cosmetics is prohibited. Paragraph 53 (2) (41) of the Law of Obligations Law provides that there is no 14 - day right to return goods purchased by telecommunications if the goods are delivered in a sealed package which is not suitable for return for health or hygiene reasons and if it is open after delivery.

Shopping cart and ordering
  1. The shopping cart is created at the moment you click on the "Add to cart" button next to the Product. Adding the product to the shopping cart does not oblige you to buy the Product.
  2. The order is considered confirmed if you have paid for the order placed in the ordering environment of the E-store. The subscriber will also receive an order confirmation from the e-store to the e-mail address he / she entered when placing the order.
  3. After confirming the order, the order will be forwarded to the E-store for filling and delivery according to the delivery method you have chosen.
  4. When entering the details of the place of delivery, carefully check the information provided and make sure that all the required information is provided and correct. The information provided by you is the basis for us to fulfill the order and deliver the Goods.
  5. The contracting authority can be a natural person with active legal capacity or a legal person with legal capacity. By submitting the order, the Customer confirms that it has the necessary legal or active capacity and / or authorization to enter into the transaction. By agreeing to the Terms and Conditions, the Subscriber confirms that his / her legal representative has given his / her consent to enter into the transaction and to use the necessary funds for this purpose.
  6. The person who has entered into a contract for the sale of goods is the person who pays for the Goods.
  7. The contract for the sale of goods shall be deemed concluded (entry into force of the contract) upon sending a confirmation of the order prepared on the basis of the shopping cart to the E-mail address entered by the Customer.

Fulfillment of the order by the E-store, methods of receiving the goods and impossibility of delivery of the goods
  1. If you have paid for the Goods (confirmed the order), the order will be sent to the e-shop, which will check the order details and arrange the order according to the delivery method you choose no later than three working days after confirming the order, unless compliance with the term is impossible .
  2. After paying for the Goods, the Goods will be delivered to the delivery location chosen by you when placing the order.
  3. The goods will be delivered to the parcel machine chosen by you when placing the order.
  4. Please check the accuracy of the information provided when ordering to avoid delays and misunderstandings in the delivery of the goods. The e-shop and the supplier of the goods are not responsible for the delay in the delivery of the goods and any misunderstandings, if the delay or misunderstanding is due to the inaccuracy or inaccuracy of the information provided by you when placing the order.
  5. The customer must take into account that access to the parcel machine may be restricted by the shopping center during the opening hours of the shopping center.
  6. The Customer agrees with the Terms and Conditions that if the Customer does not pick up the goods from the parcel machine within the time specified by the postal service provider, the goods will be returned to the e-store. The cost of the goods returned to the e-shop and the delivery fee will not be reimbursed to the Customer by the E-shop.
  7. If the Customer has not received the goods for the reason specified in clause 6, the Customer has the right to contact the e-shop and request that the goods be resent if the e-shop has not unpacked or destroyed the goods included in the shipment. If the goods assembled for the Customer have not yet been unpacked and destroyed in the e-shop, the e-shop will make a new attempt to send the goods to the Customer and the Customer will not have to pay for the goods again, but undertakes to pay the delivery fee.

Payment for the goods
  1. You can pay for the Goods ordered in the e-shop ordering environment according to the selected payment method.
  2. The goods have been paid for and the order made in the ordering environment of the E-store is considered confirmed if you have paid for the order. In addition, the order confirmation from the E-store will be sent to the e-mail address entered by the Customer. If you do not receive a notification about the confirmation of the order by the E-store within one working day after making the payment, please contact the E-store.

Liability and force majeure
1.The E-shop is liable to the Subscriber and to the other party to the Subscriber's E-store for direct damage caused by the violation of the Terms in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

2.The E-shop is not liable for damage caused to the Customer if the delivery of the Goods is delayed due to circumstances which could not be affected by the E-shop and the arrival of which could not be foreseen, including delays in the delivery of the Goods caused by possible technical failures.

Other conditions
  1. The images displayed next to the goods in the e-shop have illustrative meaning. The Customer has no right to return the Goods because the photo of the packaging of the Goods provided in the E-store does not correspond exactly to the delivered packaging of the Goods, if otherwise the Goods correspond to the order and correspond to the information displayed on the Goods in terms of name, quantity and properties.
  2. The availability of goods in the E-store is subject to change without notice. If the Customer has paid for the goods and the E-store cannot deliver it to the Customer due to the expiration of the Goods in the E-store, the E-store has the right to cancel the sale and return the money to the Customer's current account within 14 days.
  3. All personal data of the Subscriber that has become known during the visit to the E-store and the performance of purchases shall be treated as confidential information. The Customer also confirms that it grants the right to process the personal data entered by it in the E-shop to the extent necessary for the execution of the order, incl.
  4. Disputes arising from the ordering and purchase of goods between the Customer and the E-store shall be resolved through negotiations. If the negotiations do not give the desired results or if the Subscriber does not agree with the solution offered by the E-store and finds that the Subscriber's rights have been violated, the Subscriber has the right to file a complaint with the Consumer Disputes Commission through the Consumer Protection Board or a court. Contacting the Commission is free of charge for the consumer and the consumer can lodge a complaint himself or through a representative.   5. In addition to point 4, a retail customer has the right to lodge a complaint about distance selling through the European Union's Electronic Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=ET . In particular, the online dispute resolution platform, or ODR, is designed to resolve cross-border disputes, making it easier for consumers to find a specific out-of-court redress body in the trader's country of residence. In Estonia, if necessary, the EU Consumer Advice Center of the Consumer Protection Board offers assistance and advice in resolving cross-border complaints through the platform.
